Purchase conditions


1. Purchase

When ordering, a deal on purchase is made, at first, when Toomec shop has confirmed the order with an order confirmation. An order confirmation is generated automatically. If confirmed delivery time is changed the customer will be noticed as soon as possible. Toomec shop has the right to all products and the right to have them returned until full payment is made by the customer. In order to buy from us you have to be at least 18 years old.

 

2. Price

The prices include 25%VAT. When the order is confirmed the prices can only be changed due to circumstances Toomec shop is not responsible for. Such circumstances might, for example, be considerably raw material price changes, changed exchange rates or changed VAT. No service fee is charged.

 

3. Freight

Freight costs are included in the price in Sweden.

 

4. Payment conditions.

 

4.1 Invoice

- Ordered products are invoiced. Fifteen (15) days credit for private persons and thirty (30) credit days for companies.

 

4.2 Customers outside Sweden

- An extra freight cost valid for the actual country is charged.

- When ordering we send an order confirmation including facts on the extra freight cost.

 

5. Deliveries

Products in stock are normally shipped within 2 working days after confirmed order. In case of any need to order from supplier delivery time might be delayed to some extent. These products are marked and we inform the customer of delivery time in question. Delivery is made by DSV.

 

6. Delays in delivery

Sometimes there are delays in delivery out of our control. This can for example occur when a supplier cannot fulfill its delivery obligations to us. If this is the case we disclaim all responsibility for any claims for compensation on any negative effects caused by delivery delays. We will inform you on any delays in delivery.

 

7. Transport risk

Together with our freight partners we take the responsibility for any transport risk, i.e. the risk for the goods to be damaged or lost during transport from our stock to you. You and the transport company takes the risk at any return of the goods to us.

 

8. Damaged goods

When you have received the ordered goods it is important you make an immediate inspection of the goods. Should the packing and its contents be damaged please notify the transport company at once. Always keep the confirmation you will receive stating the goods is damaged. We are grateful if you will notify us as soon as possible - by no means later than within a week.

9. Rights to return a purchase

According to the Swedish law “Distansavtalslagen” you have, as a customer, the rights to, within 14 days after you have got the goods delivered to you, regret your order without the need to give any explanation. When using this right the customer pays for freight. This right is not valid when the product has been mounted, used or damaged. If you receive a bad quality product or not the product you have ordered, of course we pay for the return freight. Please contact us and we will agree upon how the freight compensation will be paid to you.

 

10. Reclaims

If you wish to reclaim a damaged or defective product please contact us via e-mail or phone within a week. Our telephone hours are 9am to 4pm weekdays. Always keep the packing material, original box and confirmation on payment. If you wish to return a damaged product to us, the easiest way to do this is to use the packing material and box it was delivered to you in. Toomec shop follows the Swedish law for consumers, “konsumentköplagen”, which states 36 months right for reclaiming the product. The right to reclaim covers only original defects on the product, i.e. existing defects at time for delivery. This is not valid in cases where we cannot find any defects within the product or when the defect is caused by the customer himself. Ordinary wear and tear on the product is not compensated.

 

11. Refunds

Repayments will be made to your bank- account or in the way the customer suggests. The refund will be made within 5 working days from our reception and approval of customer’s product return.

 

12 Reservations

We make a reservation for price changes resulting from major price changes from our suppliers, mistakes in written text or other faults out of our control. Please, read more with respect to Force Majeure below .

 

Force Majeure

In event of war, natural disaster, strikes or lockouts, authority decisions or comparable events out of our control, which cannot be reasonably predicted, and which have an influence on entered agreements and promises from our part, which force us to fail in keeping mentioned agreement or promise shall release us from our duties to fulfill this mentioned agreement. At any dispute we always follow ARN`s recommendations.
